These Terms and Conditions ("Terms") govern your access to and use of the services offered by Connect First ("Company", "we", "us", or "our"), a business communication solutions provider based in Mumbai, Maharashtra, India. By accessing our website at connect-first.in or using any of our services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please discontinue use of our services immediately.

1. Acceptance of Terms

By registering for an account, placing an order, using our platform, or otherwise engaging with Connect First's services, you enter into a binding legal agreement with us. These Terms apply to all users including businesses, individual professionals, and any representatives accessing the platform on behalf of an organisation.

These Terms, together with our Privacy Policy and any applicable Service Level Agreements or Order Forms, constitute the entire agreement between you and Connect First.

2. Our Services

Connect First provides the following business communication services to registered clients:

Bulk SMS Services

Promotional, transactional & OTP messaging to large audiences with high delivery guarantee.

WhatsApp Business API

Official Meta-approved API for rich media messaging, notifications, and chatbot automation.

Voice Call Services

Automated voice broadcasts and IVR campaigns in regional Indian languages.

Google Verified SMS

Brand-verified messaging with logos and call-to-action buttons for enhanced trust.

RCS Messaging

Rich Communication Services for interactive, app-like messaging experiences on Android.

We reserve the right to modify, suspend, or discontinue any service at any time with reasonable prior notice where feasible.

3. Eligibility & Account Registration

To use our services, you must meet the following eligibility requirements:

  • Be at least 18 years of age and legally capable of entering into binding contracts under Indian law
  • Be a registered business entity or authorised representative of one (for API and enterprise services)
  • Provide accurate, complete, and up-to-date registration information including valid GSTIN where applicable
  • Maintain the confidentiality of your account credentials and be solely responsible for all activities under your account
  • Notify us immediately at info@connect-first.in if you suspect any unauthorised use of your account

Connect First reserves the right to refuse registration, suspend, or terminate accounts that do not meet these requirements or that violate these Terms.

4. Acceptable Use Policy

You agree to use our services only for lawful business communication purposes. Permitted uses include:

  • Sending transactional messages such as order confirmations, delivery updates, OTPs, and payment receipts
  • Sending promotional messages to opted-in recipients in compliance with TRAI regulations and DLT guidelines
  • Running customer service and support workflows via WhatsApp Business API with appropriate consent
  • Conducting voice campaigns and IVR surveys with proper disclosures to recipients
  • Sending RCS and Google Verified SMS to eligible users in accordance with platform policies
Important: All messaging must comply with TRAI's Telecom Commercial Communications Customer Preference Regulations (TCCCPR) and DLT registration requirements. You are responsible for obtaining all necessary recipient consents before initiating any communication.

5. Prohibited Activities

You must NOT use Connect First's platform or services for the following purposes:

  • Sending unsolicited spam, bulk messages to unverified or non-consenting recipients
  • Distributing illegal, defamatory, obscene, threatening, fraudulent, or misleading content
  • Impersonating any person, business, government body, or brand without authorisation
  • Facilitating phishing attacks, malware distribution, scams, or financial fraud
  • Sending messages that violate the National Do Not Call (NDNC) Registry provisions
  • Using unregistered sender IDs or unapproved message templates on the DLT platform
  • Sharing account credentials with unauthorised third parties or reselling services without a written agreement
  • Attempting to reverse-engineer, hack, or disrupt any part of the Connect First platform or infrastructure
  • Violating any applicable Indian law, TRAI regulation, or telecom operator policy

Violation of this section may result in immediate suspension without refund and referral to law enforcement authorities.

6. DLT & TRAI Compliance

All SMS services in India are governed by TRAI's Telecom Commercial Communications Customer Preference Regulations. By using our SMS services, you agree to:

  • Register your business entity, sender IDs (headers), and message templates on the DLT (Distributed Ledger Technology) platform prior to sending any commercial communication
  • Ensure all message templates comply with TRAI-approved formats and category classifications (transactional, promotional, service)
  • Maintain valid consent records for promotional messaging to Indian mobile subscribers
  • Cooperate with TRAI audits and provide documentation of consent and DLT registration upon request

Connect First provides DLT registration support and guidance, but the ultimate compliance responsibility rests with you as the principal entity initiating communications. We are not liable for messages blocked or reported due to non-compliance on your part.

7. Payment & Billing

The following terms govern all financial transactions with Connect First:

  • Prepaid Model: Most services operate on a prepaid credit basis. Credits must be purchased before use and are non-refundable once consumed
  • Pricing: Service rates are subject to change. Updated pricing will be communicated via email or the platform dashboard with a minimum of 7 days' notice
  • Taxes: All prices are exclusive of applicable GST (Goods and Services Tax). GST at the prevailing rate will be added to all invoices
  • Unused Credits: Unused prepaid credits are valid for 12 months from the date of purchase unless otherwise stated in your plan agreement
  • Refunds: Refunds for unused prepaid credits may be considered on a case-by-case basis. Credits consumed in delivery attempts (including failed deliveries due to invalid numbers) are non-refundable
  • Disputed Charges: Any billing disputes must be raised in writing within 30 days of the invoice date. Disputes beyond this period will not be entertained
All payments must be made in Indian Rupees (INR). We accept NEFT, RTGS, UPI, and card payments through our authorised payment gateway.

8. Intellectual Property

All content, software, technology, branding, and materials on the Connect First platform — including but not limited to our website, APIs, documentation, logos, and trademarks — are the exclusive intellectual property of Connect First or its licensors.

  • You are granted a limited, non-exclusive, non-transferable licence to use our platform solely for your authorised business purposes
  • You may not copy, reproduce, modify, distribute, or create derivative works from any Connect First content without prior written consent
  • You retain ownership of content (message templates, contact lists) you upload to our platform, and grant us a limited licence to process it solely for service delivery
  • Any feedback, suggestions, or ideas you share with us may be incorporated into our services without obligation or compensation to you

9. Limitation of Liability

To the maximum extent permitted under applicable Indian law, Connect First shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our services
  • Loss of profits, revenue, business opportunities, data, or goodwill — even if we were advised of the possibility of such damages
  • Delays, failures, or interruptions in message delivery caused by telecom operators, network outages, or third-party infrastructure issues
  • Messages blocked, filtered, or flagged by TRAI, telecom operators, or platform providers (Meta, Google) due to compliance violations on your part
  • Unauthorised access to your account resulting from your failure to secure your login credentials

Our total cumulative liability to you for any claims arising under these Terms shall not exceed the amount paid by you to Connect First in the three (3) months preceding the event giving rise to the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Connect First, its directors, officers, employees, agents, and partners from and against any and all claims, liabilities, damages, losses, penalties, costs, and expenses (including reasonable legal fees) arising from:

  • Your violation of these Terms or any applicable law, regulation, or TRAI guideline
  • Content you transmit through our platform, including claims of defamation, spam, or intellectual property infringement
  • Your failure to obtain necessary consents from message recipients
  • Any third-party claim related to your use of our services

11. Termination

Either party may terminate the service relationship as follows:

  • By You: You may close your account at any time by contacting us at info@connect-first.in. Unused prepaid credits at the time of voluntary closure are subject to our refund policy
  • By Connect First: We may suspend or terminate your account immediately and without notice if you breach these Terms, violate TRAI regulations, engage in prohibited activities, or if continued service poses legal or reputational risk to us
  • Effect of Termination: Upon termination, your access to the platform will cease. Provisions relating to intellectual property, limitation of liability, indemnification, and governing law shall survive termination

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.

Before initiating formal legal proceedings, the parties agree to attempt to resolve any dispute amicably through good-faith negotiations for a period of 30 days from the date the dispute is raised in writing. If unresolved, disputes may be referred to binding arbitration under the Arbitration and Conciliation Act, 1996, with a sole arbitrator appointed by mutual agreement.

13. Changes to Terms

Connect First reserves the right to update or revise these Terms at any time. When material changes are made, we will:

  • Update the "Last Updated" date at the top of this page
  • Notify registered account holders via email with at least 7 days' notice before the changes take effect
  • Post a prominent notice on our platform dashboard

Your continued use of our services after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree with the updated Terms, you must stop using our services before the effective date.
